The Eviction Process: A Basic Overview of CA Eviction Timelines in Today’s MarketCategory: Real Estate Information | Permalink Published: Thursday, March 04, 2010 The California eviction process is one of the most straightforward in the entire USA. A homeowner who is foreclosed on has 3 days to vacate after being served a notice from an eviction attorney. The homeowner does not have to be present when the notice is served as it only needs to be posted to the property in a visible location. After 72 hours, a County Sheriff may show up to evict the occupant & all possessions. A tenant with a bona-fide lease/rental agreement has 90 days to vacate. In order for the lease/rental agreement to be valid, the tenant needs to provide a copy of the agreement along with copies the previous 3 payments to the bank/financial institution who has foreclosed. Prior to the eviction occurring on either a previous homeowner or a current renter/tenant, a real estate agent will usually show up at the property & do their best to contact the occupant. The real estate agent is hired by the Bank (or financial institution who has foreclosed on the property) and may make a Cash for Keys (CFK) offer to the occupant in agreement to move on an agreed upon date. The real estate agent is the main contact between an occupant & the bank/financial institution and it benefits the occupant to provide all documentation to the real estate agent as it allows the occupant to know exactly where they stand, what CFK offers may be available to them, and a date when they will need to move by. If an occupant does not cooperate with the real estate agent who visits the property then they may end up being served a notice & having to vacate 72 hours later when the Sheriff arrives.
